Affiliate Program Terms

These Affiliate Program Terms ("Affiliate Terms") govern your participation in the Build AI With Mauriel affiliate program, operated by Mbusiness Branding AI ("we," "us," or "our"). They are the separate affiliate terms referenced in section 7 of our Terms of Service. By accepting your affiliate invitation, using your affiliate link, or accepting a commission payment, you agree to these Affiliate Terms. If you do not agree, do not use your affiliate link.

Our Terms of Service also apply to you. Where these Affiliate Terms conflict with the Terms of Service on an affiliate matter, these Affiliate Terms control.

1. Joining the Program

• Participation is optional and subject to our approval. We may approve or decline any applicant at our discretion, and we may remove any affiliate at any time under section 9.
• You must be at least 18 years old and legally able to enter a contract.
• You do not have to be a paying member to be an affiliate, though most of our affiliates are members.
• Your affiliate account is personal to you. Do not share your login or your affiliate link tracking with anyone else as if it were their own.

2. Your Affiliate Link and How Sales Are Credited

• On approval you receive a unique affiliate link containing your affiliate ID. That link is the only way we can credit you. Sales from people who type the address in directly, or who arrive through a link that is missing your ID, cannot be credited after the fact.
• When someone clicks your link, we place a tracking cookie in their browser that lasts 365 days. If they purchase within that window, the sale is credited to you.
• If a buyer clicks more than one affiliate link before purchasing, the commission goes to the most recent affiliate link clicked.
• Tracking depends on the buyer's browser. Cleared cookies, private browsing, blocking tools, or buying on a different device than the one that clicked can all prevent a sale from being credited. We pay on what our tracking records, and those records are final.

3. Commission Rates

• Commissions are calculated on the amount actually collected, before our payment processing fees and excluding any taxes, and are paid in US dollars.
• Rates apply to sales credited to you while these rates are in effect. We may change rates going forward under section 10, but a rate change will not reduce commissions already earned.
• Any statement of earnings elsewhere in our marketing or emails is a summary. This section is the authoritative list of rates.

4. Payouts

• Commissions are paid on a Net-15 schedule. Commissions earned in a calendar month are paid on the 15th day of the following month. That gap also serves as our refund and chargeback buffer.
• There is a $100 minimum payout. If your balance is under $100 at a payout date, it rolls forward to the next one. Nothing is lost or expires: your balance keeps building until it clears $100, and then it is paid.
• Payouts are issued through our payment processor. You are responsible for keeping accurate payout and contact details on file. We are not responsible for payments delayed or lost because of details you gave us incorrectly.
• Before your first payout you must provide a completed W-9 (US persons) or the applicable W-8 form (non-US persons). We may withhold payouts until we have a valid form. Where required, we report affiliate earnings to the tax authorities.
• You are an independent contractor, not an employee, partner, agent, or joint venturer. You are solely responsible for your own taxes on what you earn here.

5. Refunds, Chargebacks, and Clawbacks

• Commissions are earned only on payments we actually keep. If a sale is refunded, reversed, charged back, or found to be fraudulent, the related commission is reversed.
• If the commission has not been paid yet, we deduct it from your balance. If it has already been paid, we deduct it from your next payout, or we may invoice you for it if no further payouts are expected.
• Chargebacks and refunds on sales you referred are counted against your account regardless of when they occur.
• A pattern of refunds or chargebacks on your referrals can result in removal from the program under section 9.

6. How You May Promote Us

You are welcome to promote us honestly, in your own voice, to people who would genuinely benefit. Content posts, email to your own opted-in list, videos, podcasts, live streams, honest reviews, and word of mouth are all fine.

You must clearly disclose that you earn a commission. US law requires it, and it is simply the right way to operate. A plain line such as "I earn a commission if you join through my link" placed near the link, before the click, is enough. Do not bury it, and do not rely on a disclosure that only appears after someone has already clicked.

7. What Is Not Allowed

• No bidding on our brand terms in paid search. Do not run paid ads on "Build AI With Mauriel," "Mbusiness Branding AI," "Mauriel Strawbridge," our domains, or close misspellings and variants of any of these, on Google, Bing, or any other ad platform. Do not use our brand name or domain in ad display URLs.
• No self-referral. You may not earn a commission on your own purchase, or on a purchase made by your household, your business, or an account you control. Buying through your own link to get a discount is not permitted and voids the commission.
• No spam. No unsolicited email, no unsolicited SMS, no mass direct messages, no comment or forum spam, no posting your link into groups or threads where promotion is not welcome. Only mail lists that opted in with you.
• No misleading income claims. Do not promise or imply specific earnings, "guaranteed" results, passive income, or any particular outcome from joining. Share your own real results honestly, and make clear they are your results and not a promise.
• No misrepresenting the offer. Do not advertise prices, discounts, coupons, free trials, bonuses, or refund terms that we do not actually offer, and do not list us on coupon or deal sites with codes that do not exist.
• No impersonation. Do not present yourself as us, as an employee, or as an official representative. Do not create sites, accounts, profiles, or handles that could be mistaken for our own, and do not register domains or social handles containing our brand name.
• No cookie stuffing or forced clicks. No pop-unders, iframes, redirects, auto-loading of your link, browser extensions, or any method that sets tracking without a genuine, deliberate click.
• No paid traffic that misleads, and no promotion of our brand on sites carrying adult, hateful, violent, illegal, or discriminatory content.
• No unauthorized rebates. Do not offer cash back or your own rebate for buying through your link.

8. Our Brand and Content

• You may use our name, logo, screenshots, and promotional images we provide for the purpose of promoting us, as provided, without altering the logo or wordmark.
• This is a limited, non-exclusive, revocable permission for as long as you are an active affiliate in good standing. It is not a transfer of any ownership.
• Course videos, written lessons, prompts, and member-only material are for members personally and may not be republished, resold, or given away as a bonus, whether or not you are an affiliate.
• We may ask you to correct or remove any promotion that misstates the offer or breaches these Affiliate Terms, and you agree to do so promptly.

9. Suspension, Removal, and Forfeiture

• Either of us may end your participation at any time, for any reason, with or without notice. You may leave the program at any time by telling us and by removing your links.
• When participation ends normally, we pay any commissions properly earned and unreversed, on the normal schedule, subject to the minimum payout and section 5.
• If we determine you breached section 7, we may withhold and cancel unpaid commissions, reverse commissions already paid, and remove you from the program permanently. Fraudulent activity may also be reported to the relevant platforms and authorities.
• Our determination of what counts as a breach or as fraudulent tracking activity is made in good faith and is final.

10. Changes to the Program

We may modify these Affiliate Terms, the commission rates, the cookie window, the payout schedule, or any other part of the program, and we may pause or end the program entirely. We will give notice of material changes by email or a notice in the affiliate portal. Changes apply going forward from their effective date and do not reduce commissions already earned. Continuing to use your affiliate link after changes take effect means you accept them.

11. No Guarantee of Earnings

Affiliate commissions are not guaranteed income. What you earn depends entirely on your own effort, audience, and results. Nothing here is a promise of any amount of income, and the earnings disclaimer in section 6 of our Terms of Service applies to your participation as well.

12. Liability

To the maximum extent permitted by law, our total liability to you relating to the affiliate program will not exceed the total commissions properly payable to you in the 12 months before the claim arose. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost business, or lost tracking data.

13. Governing Law

These Affiliate Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles. Any dispute will be handled in the state or federal courts located in Georgia, and you consent to their jurisdiction.
